This Privacy Policy is the basic information about the purposes, methods of processing and security of your personal data as a user of the wirsp.com website (referred as the Website) and Wirsp mobile app (referred as the Application/App). By reading the Privacy Policy, you will find out who is the administrator of your personal data, what personal data the Administrator collects, for what purposes they are used and how they are protected.

§2. Principles of data processing.

The administrator processes personal data respecting the following principles:

  • on a legal basis and in accordance with the law (legalism);
  • honestly and fairly (honesty);
  • in a transparent manner for the data subject (transparency);
  • for specific purposes and not "in reserve" (minimization);
  • no more than necessary (adequacy);
  • with attention to data correctness (correctness);
  • no longer than necessary (time);
  • ensuring adequate data security (security).

§3. Purposes and legal grounds for processing.

We process your data on the basis of your consent and to achieve the goals resulting from the legitimate interests of the Administrator (Article 6 (1) (a), (b), (f) of the GDPR).

We will process the data for the purposes of:

  • contacts to reply to your message or comment;
  • marketing and advertising, to send you commercial information (information about promotions and new offers) and information about new materials on the Website;
  • performance of the paid services ordered by you;
  • statistical and analytical, in order to monitor traffic on the Website;

Due to the fact that we process your data also on the basis of art. 6 sec. 1 f GDPR, we would like to inform you that the legitimate interests for which we need your personal data are all activities that we conduct as part of the provision of electronic services in accordance with the provisions of the Act on the provision of electronic services via the website wirsp.com.

§4. Application.

Wirsp uses the following permissions (Android):

1. Location and Background Location.

  • Location and Background Location are the basic permissions to be granted to the application in order to track the user's position in real time, as well as for calculations related to the estimated time of arrival. The background location is used only when the application is running in the navigation mode to the destination using an external navigation system, eg Google Maps, others.

2. SMS Sending.

  • Sending SMS is a permission that allows the application to send SMSes to your recipients with the content that you configure in the template settings (template + link).

    ATTENTION! After obtaining the authorization, the application sends SMS messages on your behalf (from your device), which means that there will be fees in accordance with the price list for using the SMS functions set by your mobile operator. You can view the sent messages in the default SMS application of your device.

3. Phone.

  • The Phone is a permission that allows the application to make telephone calls after clicking on the "Call the recipient" button while making the way.

    ATTENTION! After obtaining the authorization, the application establishes a telephone connection with the recipient on your behalf (from your device), which means that there will be fees in accordance with the price list for using the telephone call functions established by your mobile operator.

§5. The scope of personal data processed.

The extent to which we process your data depends on what data and for what purpose you have provided us. If you decide to contact us via e-mail, we will process the data you have provided us. If you decide to subscribe to the newsletter, we will process your e-mail address.

§6. Data retention period.

We are not able to provide you with a single date for which we will process your data. If you signed up for the newsletter, we will process your data until you cancel your subscription. If you ordered paid services, your data will be stored for the period required by tax regulations. We will process other data related to the provision of electronic services for an indefinite period, at least until you submit a request for data deletion or objection.

When subscribing to the newsletter, we inform you that the Administrator reviews the activity of newsletter subscribers at least once a year. Users who have not used any of the links sent for six months will be considered inactive and removed from the database of addresses.

§7. Personal data breach proceedings.

Any person who notices a threat to the security of personal data collected by the Administrator or witnesses a breach of personal data should immediately inform the Administrator about it.

The administrator should notify the President of the Personal Data Protection Office within 72 hours from finding the violation, unless it is unlikely that the violation would result in a risk of violating the rights or freedoms of natural persons.

§7. User rights.

In connection with the processing of your data, you have the following rights:

  • access to the content of your data and
  • the right to rectify, delete, limit processing,
  • the right to data portability,
  • the right to object,
  • the right to withdraw consent to their processing at any time and in any form, unless the processing of your data takes place in order to perform the contract by the Administrator, in order to fulfill the Administrator's legal obligations towards state institutions or to implement the Administrator's legitimate interests.

You also have the right to lodge a complaint with the President of the Office for Personal Data Protection (to the address of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

§9. Cookies.

Cookie files (so-called "cookies") are IT data, in particular text files, which are stored on the end device, i.e. your computer, laptop or smartphone, depending on which device you use to view the Website. Cookies usually contain the name of the website they come from, the storage time on the end device and a unique number. You can decide on the form of using cookies - these settings are available in every web browser.

Cookies are primarily your convenience - thanks to their use, the loading time of the page is significantly reduced during subsequent visits.
